Terms of Service

Terms that govern the Podcentro website and services.

These terms cover use of the public website, membership applications, and agreed print-on-demand services.

1. What these words mean

2. Accepting the terms

Using the website, sending an application or inquiry, creating an account, or placing an order means you accept this Agreement. If you do not accept it, do not use the Services. A separate written onboarding agreement controls production, pricing, and service levels where it says something different from this public page.

These terms, and the policies they name, are the complete public agreement for website use. They replace earlier website statements on the same subjects. If one sentence cannot be enforced, the rest stays in effect.

3. Changes

Podcentro may update these terms. The date at the top of this page is the effective date of the current version. Continued use after that date means you accept the update. If you do not accept an update, stop using the Services and close any account you have. Material changes may also be sent to the email address you gave us.

4. What Podcentro does

Podcentro helps approved members match original artwork to catalog products and route eligible orders into production. Items are made after an order is authorized. Blank goods, print methods, and carriers may involve third parties. Podcentro does not operate your store, set your retail price, or own the relationship with your Customer.

Catalog pages, mockups, and planning tools are illustrations and estimates. A digital mockup is not a promise that the finished object will match the screen in color, scale, texture, or placement. Channel availability, artwork rules, and prices are confirmed in writing before launch. Sending an application does not create a service contract, an integration, or a price quote.

Podcentro may change, pause, or withdraw a product, feature, or workflow. The website and any account area may be unavailable during maintenance, security work, or events outside Podcentro’s control. Using the Services does not make you an employee, agent, or partner of Podcentro.

5. Who may use the Services

You must be at least 18 years old and able to form a contract. You are responsible for taxes that apply to your sales and to your use of the Services. Podcentro may collect tax where the law requires it. Channel rules, sanctions, and export rules still apply to you even when Podcentro produces an item.

6. Applications and accounts

Membership is reviewed. Podcentro may accept, refuse, limit, or end an application or account. If you receive account access, you agree to:

Threats, harassment, or abuse toward Podcentro staff can lead to suspension or closure. Before an account is closed you should disconnect sales channels, finish or cancel open orders, and pay amounts already due. Closing an account does not erase charges for work already started.

7. Your content

You keep ownership of Content you submit. You give Podcentro a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt, print, and display that Content so Podcentro can produce products, fulfill orders, show proofs, support your account, and present anonymized or approved examples of the service. The license ends when the Content is no longer needed for those purposes, except for copies kept for orders, disputes, security, and legal duties.

You confirm that you have the rights needed to commercialize the Content, including any artwork made with artificial intelligence or other automated tools. Podcentro does not check every file for originality and does not promise that generated artwork is free of third-party claims. Details are in the Intellectual Property Policy and the Copyright and DMCA page.

8. Content Podcentro will not produce

Do not submit Content that:

Podcentro may refuse, remove, or stop producing Content that appears to break these rules or the law, and may suspend the related account.

9. Orders and payment

Product cost, shipping, and any other fees are those confirmed for your account or quoted for the order. Unless a written quote says otherwise, production cost and shipping are separate, and marketplace fees, advertising, returns, duties, and taxes are yours to plan for.

Report an order problem to Podcentro before opening a payment dispute. Reprint and refund rules are in the production and shipping policy.

10. Production, shipping, and customers

Published times are estimates. Carriers, not Podcentro, move the parcel after it is handed over. You remain responsible for listing accuracy, customer messages, and the retail promise you publish. Do not state a delivery date the confirmed production window and carrier service cannot support.

11. Podcentro’s name and materials

The Podcentro name, logo, site design, and other brand assets belong to Podcentro. Do not use them in a way that suggests sponsorship, partnership, or approval unless Podcentro agrees in writing. You may say, truthfully, that you use Podcentro to produce products. Press or brand files that Podcentro marks as available may be used only on the conditions stated with those files.

12. Disclaimers and limits

The website, tools, and Services are provided as available. Podcentro does not promise uninterrupted access, error-free files, a particular sales result, or that a third-party store, payment service, or carrier will accept or complete a transaction.

To the extent the law allows, Podcentro and its staff and service providers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. This includes loss caused by a sales channel, carrier, or other third party. Podcentro’s total liability for a claim arising out of the Services is limited to the greater of the amount you paid Podcentro for the order or service that gave rise to the claim and 100 U.S. dollars. Some places do not allow these limits. Where that is the case, the limit applies only as far as the law allows.

You will defend and hold harmless Podcentro and its staff from claims, damages, and reasonable legal fees arising from your Content, your listings, your breach of this Agreement, your violation of law or third-party rights, or your negligence or misuse of the Services.

13. Disputes

Contact hello@podcentro.com and describe the dispute before starting a formal proceeding. If it is not resolved within 30 days after that notice, either party may bring an individual claim in the state or federal courts located in Pinellas County, Florida. These terms are governed by the laws of the State of Florida, excluding conflict-of-law rules. To the extent the law allows, you and Podcentro will bring claims only on an individual basis, not as a class, collective, or representative action.

14. Contact

Questions about these terms: hello@podcentro.com, or Podcentro, 7901 4th St N, Ste 34250, St. Petersburg, FL 33702.
